A copyright does not protect an idea but, rather, your expression of that idea. A copyright is formed when your work becomes fixed in a tangible medium of expression, such as a book or recording. Once this has occurred, you gain the right to copy your work and to exclude others from copying it. Copyright protection for works created after January 1, 1978 generally extends for the life of the author plus 70 years. The duration can be different when they involve works-for-hire. When dealing with a work-for-hire it is important to establish in writing the terms of your agreement and who will own the work once created. We can assist you in drafting or reviewing a work-for-hire agreement.
While not required, the small cost of obtaining a copyright registration prior to infringement, may allow you to recover statutory damages as high as $150,000 per infringing use. It is therefore, important to register your copyright within three months of its first publication.
